Les \u00c9tats peuvent pallier les p\u00e9nuries de main-d\u2019\u0153uvre en r\u00e9duisant les obstacles \u00e0 l\u2019obtention d\u2019un droit d\u2019exercer et en offrant un meilleur acc\u00e8s aux r\u00e9sidents form\u00e9s \u00e0 l\u2019\u00e9tranger.\u00a0<\/p>\n\n<p>Chaque \u00c9tat fixe ses propres conditions d\u2019\u00e9ligibilit\u00e9 pour l\u2019obtention d\u2019un droit d\u2019exercer. \u00c0 l\u2019heure actuelle,<strong> <a href=\"https:\/\/www.ncsl.org\/labor-and-employment\/the-national-occupational-licensing-database\" target=\"_blank\" rel=\"noreferrer noopener\">1\u00a0emploi sur\u00a04 n\u00e9cessite un droit d\u2019exercer, une certification ou une autre qualification formelle qui reconna\u00eet l\u2019\u00e9ducation et la formation des travailleurs, et autorise ces derniers \u00e0 exercer leur profession<\/a><\/strong>. Il y a soixante ans, ce nombre \u00e9tait de 1\u00a0emploi sur\u00a020. Malgr\u00e9 cette multiplication par cinq, les conditions d\u2019admissibilit\u00e9 \u00e0 l\u2019obtention d\u2019un droit d\u2019exercer tiennent rarement compte de la formation et de l\u2019exp\u00e9rience acquises dans d\u2019autres pays. Par cons\u00e9quent, bon nombre des emplois les plus demand\u00e9s dans des secteurs comme les soins de sant\u00e9 exigent que des immigrants et des r\u00e9fugi\u00e9s d\u00e9j\u00e0 exp\u00e9riment\u00e9s reprennent des \u00e9tudes et une formation co\u00fbteuses et chronophages. Les m\u00e9decins form\u00e9s \u00e0 l\u2019\u00e9tranger doivent franchir un obstacle particuli\u00e8rement \u00e9lev\u00e9, car de nombreux \u00c9tats exigent qu\u2019ils recommencent leur internat m\u00e9dical aux \u00c9tats-Unis malgr\u00e9 leur exp\u00e9rience de travail \u00e0 l\u2019\u00e9tranger en tant que m\u00e9decins.\u00a0\u00a0<\/p>\n\n<p>R\u00e9cemment, le Maryland, la Virginie et l\u2019Utah ont introduit des r\u00e9formes susceptibles d\u2019accro\u00eetre de mani\u00e8re significative l\u2019acc\u00e8s \u00e0 l\u2019obtention d\u2019un droit d\u2019exercer et de pallier les p\u00e9nuries de main-d\u2019\u0153uvre. Pour les autres \u00c9tats int\u00e9ress\u00e9s, ils donnent l\u2019exemple.\u00a0<\/p>\n\n<p>Le Maryland a \u00e9largi<strong> <a href=\"https:\/\/dsd.maryland.gov\/regulations\/Pages\/10.27.01.05.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">les options pour les examens de comp\u00e9tence en anglais<\/a><\/strong><a href=\"https:\/\/dsd.maryland.gov\/regulations\/Pages\/10.27.01.05.aspx\" target=\"_blank\" rel=\"noreferrer noopener\"> <\/a>pour permettre \u00e0 davantage de membres du personnel infirmier form\u00e9s \u00e0 l\u2019\u00e9tranger d\u2019obtenir un droit d\u2019exercer et de faire face aux p\u00e9nuries de main-d\u2019\u0153uvre dans l\u2019\u00c9tat. Avant les modifications r\u00e9glementaires, le Maryland Board of Nursing n\u2019avait approuv\u00e9 qu\u2019un nombre limit\u00e9 de tests en anglais, ce qui posait un d\u00e9fi important aux candidats ayant besoin d\u2019autres options d\u2019examen. Les options \u00e9largies de tests en anglais offrent un meilleur acc\u00e8s et une plus grande souplesse au personnel infirmier form\u00e9 \u00e0 l\u2019\u00e9tranger sans compromettre la qualit\u00e9 des soins. D\u2019apr\u00e8s les pr\u00e9visions, au moins 80\u00a0membres du personnel infirmier du Maryland peuvent tirer parti de ce changement de r\u00e8gle.\u00a0<\/p>\n\n<p>En avril, <a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?241+sum+HB995#:~:text=SUMMARY%20AS%20INTRODUCED%3A&amp;text=Permits%20the%20Board%20of%20Medicine,in%20a%20medically%20underserved%20area.\" target=\"_blank\" rel=\"noreferrer noopener\"><strong> la Virginie a adopt\u00e9 une loi<\/strong><\/a> \u00e9tablissant un moyen de permettre aux m\u00e9decins dipl\u00f4m\u00e9s \u00e0 l\u2019\u00e9tranger (IMG, ou International Medical Graduate) \u00e9ligibles d\u2019exercer la m\u00e9decine dans le cadre d\u2019une licence provisoire et restreinte pendant qu\u2019ils obtiennent le plein droit d\u2019exercer. Pour \u00eatre admissibles \u00e0 une licence provisoire, les IMG doivent d\u00e9montrer qu\u2019ils ont au moins cinq ans d\u2019exp\u00e9rience pr\u00e9alable dans la pratique m\u00e9dicale, r\u00e9ussir les \u00e9tapes\u00a01 et\u00a02 de l\u2019examen de licence m\u00e9dicale des \u00c9tats-Unis et obtenir un certificat de l\u2019<a href=\"https:\/\/www.ecfmg.org\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Educational Commission for Foreign Medical Graduates<\/strong><\/a> (Commission \u00e9ducative pour les dipl\u00f4m\u00e9s \u00e9trangers en m\u00e9decine). Les IMG peuvent ensuite travailler dans le cadre d\u2019un droit d\u2019exercer provisoire pendant deux ans, tout en b\u00e9n\u00e9ficiant d\u2019une formation suppl\u00e9mentaire, apr\u00e8s quoi ils peuvent demander une licence restreinte renouvelable de deux ans pour exercer dans les zones m\u00e9dicalement mal desservies de l\u2019\u00c9tat. Apr\u00e8s avoir exerc\u00e9 dans le cadre de leurs licences provisoires et restreintes, et avoir effectu\u00e9 des tests et formations suppl\u00e9mentaires, les IMG peuvent alors exercer leurs comp\u00e9tences dans le cadre d\u2019une licence compl\u00e8te et partout dans l\u2019\u00c9tat, tout comme leurs pairs form\u00e9s aux \u00c9tats-Unis.\u00a0<\/p>\n\n<p>Enfin, l\u2019Utah est \u00e0 l\u2019avant-garde du pays en mati\u00e8re de promotion d\u2019\u00e9conomies inclusives pour les personnes form\u00e9es \u00e0 l\u2019\u00e9tranger. L\u2019ann\u00e9e derni\u00e8re, les <a href=\"https:\/\/le.utah.gov\/~2023\/bills\/static\/SB0035.html\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>l\u00e9gislateurs de l\u2019\u00c9tat ont adopt\u00e9 des amendements<\/strong><\/a> au code des licences professionnelles de l\u2019\u00c9tat qui ont cr\u00e9\u00e9 des moyens inclusifs d\u2019obtention d\u2019un droit d\u2019exercer pour les personnes qui sont ou ont d\u00e9j\u00e0 \u00e9t\u00e9 autoris\u00e9es \u00e0 exercer dans un autre \u00c9tat, territoire ou pays, et\/ou qui ont une formation, une exp\u00e9rience et des comp\u00e9tences qui d\u00e9montrent leur comp\u00e9tence. En vertu des amendements, les personnes pr\u00e9c\u00e9demment titulaires d\u2019une licence peuvent obtenir une licence si elles prouvent que (1) elles ont au moins un an d\u2019exp\u00e9rience pratique dans le cadre d\u2019une licence d\u00e9livr\u00e9e dans un autre \u00c9tat, territoire ou pays\u00a0; ou (2) les exigences de droit d\u2019exercer de l\u2019autre \u00c9tat, territoire ou pays sont \u00ab\u00a0substantiellement similaires\u00a0\u00bb aux exigences de l\u2019Utah.
